Terms of service

1. Agreement. These Terms of Service ("Terms") are an agreement between you and BMO Services LLC, doing business as BBQ Source Pro ("BBQ Source Pro," "we," "us"). By using bbqsourcepro.com or placing an order, you agree to these Terms and to our Refund Policy, Brand-Specific Return Policy, Shipping Policy, Freight Claims Policy and Privacy Policy (the "Policies"), which are part of these Terms. If you do not agree, do not place an order.

2. Eligibility. You must be at least 18 years old and able to enter a binding contract. We sell to customers in the contiguous United States. Alaska and Hawaii are quoted on request. We do not ship internationally.

3. How we fulfill orders. BBQ Source Pro is an authorized dealer. Most products ship directly from the manufacturer or an authorized distributor, not from our own warehouse. Lead times, stock and delivery dates depend on the manufacturer and the carrier, and all dates we provide are estimates.

4. Orders and acceptance.

Your order is an offer to buy. Our order confirmation email only confirms that we received it.
A contract is formed when we confirm availability with the manufacturer and ship, or confirm the order to you in writing.
We may decline or cancel any order before then, including for pricing or listing errors, unavailable stock, suspected fraud, or orders placed for resale. If we cancel, we refund what you paid in full.

5. Prices, errors and taxes.

Prices are in U.S. dollars and may change without notice.
If a product is listed at an incorrect price, we may cancel the order or contact you with the correct price before it ships, even after you receive an order confirmation.
Sales tax is charged where required by law.

6. Cancellations.

Within 24 hours of ordering: you may cancel at no charge if the order has not yet been placed with the manufacturer.
After that, and before it ships: a cancellation fee of 15% of the order total applies to cover manufacturer and processing charges.
Once shipped: the order cannot be canceled. It may only be returned under our Refund Policy.
Custom, made-to-order and final-sale items (Meadow Creek, Cotton Gin Smokers, Old Country BBQ Pits, Tribal Fire Grills, and any special-order item) cannot be canceled once ordered.

7. Shipping, title and risk of loss.

Delivery terms are in our Shipping Policy.
Title and risk of loss pass to you when the product is delivered to your shipping address.
Damage or loss in transit is handled under our Freight Claims Policy. You must follow its inspection and 48-hour reporting rules for us to recover from the carrier.

8. Returns. Returns are governed by our Refund Policy and Brand-Specific Return Policy. If they conflict, the Brand-Specific Return Policy controls.

9. Warranties.

Products are covered only by the manufacturer's written warranty, which the manufacturer provides and administers. BBQ Source Pro does not issue its own warranty, but we will help you file a warranty claim.
To the fullest extent permitted by law, BBQ Source Pro disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose.
Product descriptions, specifications and images come from manufacturers and are for reference. Always confirm dimensions, cut-outs, fuel type and clearances with the manufacturer's installation manual before buying or building.

10. Installation, use and safety.

Gas, electrical and built-in installations must be performed by a qualified, licensed professional, following the manufacturer's instructions and all local codes, permits and HOA rules.
Grills, smokers, burners and outdoor ovens are for outdoor use only, with the clearances the manufacturer specifies.
BBQ Source Pro does not install products. We are not responsible for injury, property damage, fire or loss caused by improper installation, assembly, modification, misuse, or failure to follow the manufacturer's instructions.
Fuel conversions (natural gas to propane or propane to natural gas) must use the manufacturer's kit and be performed by a qualified technician.

11. Limitation of liability.

To the fullest extent permitted by law, our total liability for any claim relating to a product or order is limited to the amount you paid for that product.
We are not liable for indirect, incidental, special or consequential damages, including installation or construction costs (islands, countertops, masonry, gas lines), lost use, or delays.
Some states do not allow these limits, so they may not apply to you.

12. Chargebacks.

Before disputing a charge, contact us at support@bbqsourcepro.com so we can resolve the issue.
Opening a chargeback for an order that was delivered as described, or that is being handled under our Policies, may be treated as a breach of these Terms. We will provide our records to your card issuer, including delivery confirmation, signed delivery receipts and your agreement to these Terms.

13. Disputes. Any dispute will be resolved in the state or federal courts located in Cuyahoga County, Ohio, and you and we consent to their jurisdiction. Either party may bring a claim in small-claims court instead.

14. Governing law. These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules.

15. Website use.

You may not use the site for unlawful purposes, scrape it, or interfere with its security.
Site content, photos and text are owned by us or our licensors and may not be copied without permission.
Links to third-party sites are provided for convenience only.

16. Indemnification. You agree to indemnify BBQ Source Pro against claims caused by your breach of these Terms, your misuse of a product, or improper installation performed by you or your contractor.

17. General.

If any part of these Terms is unenforceable, the rest remains in effect.
Our failure to enforce a term is not a waiver of it.
We may update these Terms by posting a new version with a new date. The version in effect when you placed your order applies to that order.
